These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("Customer," "you," or "your") and ClaroPure/Claro Mold Testing & Treatment ("Company," "we," "our," or "us") regarding your use of our website at www.claropure.com and our mold testing and remediation services. By accessing our website, scheduling services, or entering into a service agreement with us, you agree to be bound by these Terms.

Services Overview
ClaroPure provides professional mold testing, inspection, and remediation services including but not limited to:
- Mold testing and assessment
- Complete home mold treatment using patented dry-fog technology

- One-year guarantee on mold remediation services

Our services are available in Middle Tennessee including Nashville, Franklin, Brentwood, Murfreesboro, and surrounding areas as specified on our service area page.
Scheduling and Appointments
Initial Consultation
- Free consultations and estimates are provided at our discretion
- Scheduling requires providing accurate contact information and property details
- We reserve the right to refuse service for any reason
Appointment Changes
- Changes or cancellations must be made at least 24 hours in advance
- Last-minute cancellations (less than 24 hours) may incur a service fee
- Weather conditions or emergencies may require rescheduling
Pricing and Payment Terms
Service Pricing
- All pricing is subject to change without notice
- Final pricing is determined after initial assessment and may vary from estimates
- Written quotes are valid for 30 days unless otherwise specified
Payment Terms
- Payment is due upon completion of services unless otherwise agreed in writing
- We accept cash, check, and major credit cards
- Late payments may incur additional fees as permitted by law
- A service charge may apply for returned payments
Additional Costs
- Costs for additional services discovered during inspection will be discussed and approved before proceeding
- Travel fees may apply for locations outside our standard service area
Service Performance and Limitations
Pre-Service Requirements
- Customer must provide safe and reasonable access to all areas requiring treatment
- Customer is responsible for removing or protecting personal belongings as recommended
- Utilities (electricity, water) must be available during service performance
- Customer must disclose known health conditions or sensitivities
Service Limitations
- Services are contingent upon weather conditions and property accessibility
- We reserve the right to refuse or postpone service if conditions are deemed unsafe
- Certain structural or environmental conditions may limit treatment effectiveness
- Customer must address underlying moisture issues for optimal results
Our Guarantee
- We provide a one-year guarantee on our mold remediation services as specified in your service agreement
- Guarantee coverage requires following all post-treatment recommendations
- Guarantee is void if moisture issues are not addressed or new water damage occurs
- Guarantee coverage is limited to the areas and conditions specified in the original service agreement
Customer Responsibilities
Property Preparation
- Follow all pre-service preparation instructions provided
- Ensure safe access to treatment areas
- Remove or cover items as recommended
- Inform us of any changes to property conditions
Health and Safety
- Disclose any relevant health conditions or concerns
- Follow all safety recommendations during and after treatment
- Ventilate areas as instructed post-treatment
- Report any adverse reactions immediately
Post-Treatment Care
- Follow all post-treatment instructions and recommendations
- Address underlying moisture or ventilation issues
- Allow proper curing time before re-occupying treated areas
- Maintain recommended humidity levels
Health and Safety Disclaimers
Treatment Safety
- Our treatments use EPA-registered, family-safe products
- Temporary evacuation may be required during treatment
- Individuals with severe respiratory conditions should consult healthcare providers
- We are not responsible for pre-existing health conditions
Results Disclaimer
- Individual results may vary based on property conditions and mold severity
- Complete elimination of all airborne spores cannot be guaranteed due to environmental factors
- Treatment effectiveness depends on addressing underlying moisture sources
- We make no medical claims regarding health improvements
Liability and Insurance
Limitation of Liability
- Our liability is limited to the cost of services performed
- We are not liable for indirect, consequential, or punitive damages
- We carry appropriate professional liability and general liability insurance
- Property damage coverage is subject to insurance policy limits and terms
Customer Property
- Customer is responsible for protecting or removing valuable items
- We are not responsible for damage to improperly prepared areas
- Claims for property damage must be reported within 48 hours of service completion
- We recommend Customer maintain homeowner's insurance coverage
Warranty and Guarantee Terms
Service Guarantee
- One-year guarantee applies to areas treated as specified in service agreement
- Guarantee requires following all maintenance and care instructions
- Guarantee does not cover new mold growth from new moisture sources or water damage
- Re-treatment under guarantee requires inspection and may involve additional costs for addressing new issues
Warranty Limitations
- Guarantee is non-transferable and applies only to original Customer
- Structural modifications or renovations may void guarantee coverage
- Force majeure events (floods, storms, etc.) are excluded from guarantee coverage
Intellectual Property
Proprietary Methods
- Our treatment processes and methods are proprietary and protected
- Customers may not attempt to replicate or reverse-engineer our processes
- All documentation and reports remain our intellectual property
Website Content
- All website content is protected by copyright and trademark laws
- Customers may not reproduce or distribute our content without permission
Privacy and Confidentiality
Customer Information
- We maintain confidentiality of Customer information and property conditions
- Information may be shared with service providers necessary for treatment
- We comply with all applicable privacy laws and regulations
Property Access
- We respect Customer privacy and property rights
- Access is limited to areas necessary for service performance
- Customers will be informed of all personnel entering the property
Dispute Resolution
Resolution Process
- Disputes should first be addressed directly with our management
- We will make reasonable efforts to resolve issues promptly and fairly
- Written documentation of concerns helps facilitate resolution
Legal Jurisdiction
- These Terms are governed by Tennessee state law
- Any legal proceedings will be conducted in Williamson County, Tennessee
- Both parties agree to attempt mediation before litigation
Termination of Services
Customer Termination
- Customers may terminate services before completion with written notice
- Termination fees may apply for work already performed or materials purchased
- No refunds for completed work or services
Company Termination
- We reserve the right to terminate services for non-payment, safety concerns, or breach of Terms
- Customer will be billed for all work completed up to termination date
Force Majeure
We are not liable for delays or failure to perform due to circumstances beyond our reasonable control, including but not limited to:
- Weather conditions affecting safety or treatment effectiveness
- Government regulations or restrictions
- Equipment failures or supplier issues
- Natural disasters or emergencies
Modifications and Updates
Terms Changes
- These Terms may be updated periodically
- Significant changes will be communicated to active customers
- Continued use of services indicates acceptance of updated Terms
Service Changes
- We reserve the right to modify or discontinue services
- Existing contracts will be honored according to original terms
Severability
If any provision of these Terms is deemed invalid or unenforceable, the remaining provisions will continue in full force and effect.
